DMCA Policy
Giana Segredo Clich㪠is committed to respecting the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have adopted the policy below to address claims of copyright infringement.
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Giana Segredo Clich㪠service, please notify our Designated Copyright Agent, as set forth below. For your complaint to be valid under the DMCA, you must provide the following information when providing notice of the claimed copyright infringement:
Filing a DMCA Notice of Infringement
- An electronic or physical signature of a person authorized to act on behalf of the copyright owner.
- Identification of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work.
- Identification of the material that you claim is infringing and where it is located on the Giana Segredo Clich㪠service (e.g., the URL of the specific content).
- Information reasonably sufficient to permit Giana Segredo Clich㪠to contact you, such as your address, telephone number, and, if available, an electronic mail address.
- A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or law.
- A statement, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Please note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.
DMCA Counter-Notification
If you believe that your content, which was removed or disabled, is not infringing or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material, you may send a counter-notice containing the following information to our Designated Copyright Agent:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or a misidentification of the material to be removed or disabled.
- Your name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the federal court in [Jurisdiction for Giana Segredo Clichãª, e.g., "the judicial district where your address is located"], and a statement that you will accept service of process from the person who provided notification of the alleged infringement.
If a counter-notice is received by the Designated Copyright Agent, Giana Segredo Clich㪠may send a copy of the counter-notice to the original complaining party informing that person that Giana Segredo Clich㪠may replace the removed material or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed material may be replaced or access to it restored in 10 to 14 business days or more after receipt of the counter-notice, at Giana Segredo Clichãª's sole discretion.
